§ 2-17-1. Conveyance of county-owned property to nonprofit agencies.

  • (a)

    The purpose of this section is to establish that the conveyance of certain county-owned property to a not-for-profit organization for the development of single-family or multifamily housing and the subsequent conveyance of that property to a homeowner or development of that property for rental housing pursuant to Florida Statutes Section 125.38, and as provided in this section serves the community interest and welfare.

    (b)

    Nonprofit organizations meeting the requirements of Florida Stautes Section 125.38, developing affordable housing may make application to the county for the conveyance of property determined to be available for development of multifamily and single-family houses pursuant to this section.

    (c)

    County property conveyed to a nonprofit organization pursuant to this section for homeownership may be conveyed by the nonprofit to individuals meeting the requirements for assistance under the county's SHIP or HOME programs and shall otherwise be developed in accordance with the county's SHIP or HOME programs as the same may be amended from time to time.

    (d)

    Property conveyed to a nonprofit organization for development of multifamily rental housing shall be used as rental housing for individuals eligible for assistance under the county's SHIP or HOME programs and be developed in a manner consistent with the SHIP or HOME programs as the same may be amended from time to time.

    (e)

    The board of county commissioners may adopt such policies and resolutions as may be required to implement the provisions of this section and shall enter into agreements subject to such additional conditions and restrictions as the board may deem necessary and appropriate to effectuate the county's SHIP and HOME programs and secure the use of the property in a manner consistent with applicable plans and rules.
