Article III. MANATEE COUNTY SECONDARY METALS RECYCLERS AND PAWNBROKERS ORDINANCE |
§ 2-19-45. Penalties for violation.
(1)
All violations of this article may be processed according to the provisions of Part I or Part II of Chapter 162, Florida Statutes, as may be applicable. Law enforcement officers or code enforcement officers are specifically authorized to issue a citation for each violation in accordance with section 2-2-25 of the Manatee County Code. Each day of any such violation shall constitute a separate and distinct offense. Further, each failure to properly document transaction information shall constitute a separate and distinct offense.

The county may also enforce this article by action in equity, including injunctive or declaratory relief, in the appropriate court of competent jurisdiction.
(3)
Any person who knowingly violates any provision of this article, including refusal to allow a law or code enforcement officer to make an inspection under this article, shall also be punished by a fine not to exceed five hundred dollars ($500.00) or by imprisonment in the county jail not to exceed sixty (60) days, or by both fine and imprisonment. Each day of violation of this ordinance shall be considered a separate incident for purposes of prescribing penalties.
(4)
A secondary metals recycler is presumed to know upon receipt of stolen property in any transaction that the property has been stolen from another if the secondary metals recycler knowingly and intentionally fails to maintain the information required in Chapter 538, Florida Statutes, and this article.
