Article IV. CONVENIENCE STORES |
§ 2-19-61. Definitions.
A used in this article, the following terms shall have the following meanings:
Convenience store. Any place of business that is engaged in the retail sale of groceries, including the sale of prepared foods, gasoline or services,t hat is regularly open for business at any time between the hours of 6:00 p.m. and 6:00 a.m., and which contains four (4) or less cash registers or check-out areas. The term "convenience store" does not include a store which is solely or primarily a restaurant. The term "convenience store" does not include a business which engages solely or primarily in the sale of alcoholic beverages for consumption on the premises. The term "convenience store" does not include any store in which the owner and members of his/her family on the premises and work in the store between the hours of 6:00 p.m. and 6:00 a.m.
Employee. Any person performing check-out, stocking, or food preparation services on the premises of a convenience store, whether for hire or gratuitously.
Owner. The person, corporation, partnership, joint venture or other group enterprise having lawful ownership or possession of the premises upon which a convenience store is operated.
