§ 2-19-64. Penalties.
(a)
Any owner or principal operator of a convenience store who willfully and deliberately violates any requirement of this article or who deliberately fails to initially implement the requirements of this article shall be required to pay to Manatee County, upon complaint filed by Manatee County, a civil fine to be determined as follows:
(1)
For the first violation—Up to $500.00.
(2)
For the second violation—Up to $1,000.00.
(3)
For the third violation—Up to $1,500.00.
(4)
For the fourth violation—Up to $2,500.00.
(5)
For the fifth violation—Up to $5,000.00.
(b)
In addition to or in lieu of the foregoing civil penalties, any owner or principal operator of a convenience store who knowingly violates any provision of this article shall, upon conviction, be punished according to law and shall be subject to a fine not exceeding the sum of five hundred dollars ($500.00) or imprisonment in the county jail for a period not exceeding sixty (60) days, or both such fine and imprisonment.
(c)
Notwithstanding the foregoing, if any noncompliance with or violation of this article is corrected within ten (10) days after receipt by an owner or employee of a written notice of violation from a law enforcement officer or code enforcement officer, no civil or criminal penalties shall be imposed.
