Article IX. SAFE, UNOBSTRUCTED ACCESS TO PUBLIC BUILDINGS |
§ 2-21-121. Definitions.
(a)
The following definitions will apply to this article:
(1)
Historic Courthouse is the building located between Manatee and 6th Avenues on 12th Street West in Bradenton, Florida; physical address of 1115 Manatee Avenue West, including the porticos, porches, external steps and stairwells thereof, the landscaped areas, alleys and sidewalks surrounding it, and the park-like area and memorials between its north-facing side and Manatee Avenue.

Judicial Center is the building located between Manatee and 6th Avenues on 10th Street West in Bradenton, Florida; physical address of 1051 Manatee Avenue West, including the porticos, porches, external steps and stairwells thereof, the landscaped areas, alleys and sidewalks surrounding it.
(3)
Public buildings means all buildings, as well as the steps, sidewalks and grounds immediately adjacent to all such buildings, owned, leased, occupied or maintained by Manatee County or the City of Bradenton, in whole or in part, and includes, but is not limited to: the Historic Courthouse; the Manatee County Judicial Center; the Downtown Bradenton Parking Garage located at 12th Street West and 8th Avenue West, Bradenton; the Manatee County Administration Building on Manatee Avenue between 10th and 12th Streets West, Bradenton, and its adjacent parking garage; the facilities of the Manatee County Sheriff at 601 301 Boulevard West, Bradenton, District II, 407 57th Avenue East, Bradenton, District III, 5030 U.S. Highway 301 North, Ellenton, District V, 10005 Gulf Drive, Anna Maria, Manatee County Central Jail, 14470 Harlee Road, Palmetto; the offices of the Manatee County Supervisor of Elections at 600 301 Boulevard West, Bradenton; the offices of the Manatee County Property Appraiser at 915 4th Avenue West, Bradenton; offices of the Manatee County Tax Collector at 819 301 Boulevard West, Bradenton, 6007 111th Street East, Bradenton, 1341 10th Street East, Palmetto, and 7411 Manatee Avenue West, Suite 200, Bradenton; the Public Safety Center at 2101 47th Terrace East, Bradenton; the Main Library on Barcarrota Boulevard, and other branch libraries; the public health buildings on 6th Avenue East; the Civic Center in Palmetto; Bradenton City Hall on 15th Street West; the City of Bradenton Municipal Auditorium between 10th and 12th Streets West; the City of Bradenton Public Works Building on 9th Street West; and all other facilities now or hereafter used by Manatee County, its elected officials, and the City of Bradenton, except those otherwise designed as parks.

Reasonable explanation is one which would satisfy a person of ordinary intelligence that the individual being questioned is present at the particular site for a purpose consistent with the time of day, the day of the week, the time of year, and the business normally conducted at that site, or that the individual has special permission to conduct activities at that site, or that the individual is lawfully exercising a Constitutional right.

To lodge means more than merely napping or sleeping for a short period; instead, it means using a site as a temporary habitation for several continuous hours or overnight.
(6)
To beg or panhandle means to accost passersby to solicit money or things of value for oneself; the phrase does not include soliciting donations for a charitable organization, as defined in Section 496.404(1), Florida Statutes.
(7)
To obstruct pedestrian traffic means to lounge or remain on sidewalks and buildings steps in such a way as to block or to cause pedestrians to step over or around a violator or to deviate from their most direct routes to or from public buildings.
(8)
Legitimate government purposes means the normal activities conducted at the site by members of the public; or, in the case of government employees, the performance of official work at the site; or in the case of expressive conduct, the lawful exercise of Constitutional rights.
