§ 2-21-89. Permits.

  • (a)

    Manufacturers, distributors, wholesalers and retailers. Prior to manufacturing or selling any fireworks within Manatee County, a permit must first be obtained from the county. A permit applicant shall present to the county a one hundred dollar ($100.00) permit fee, along with a sworn affidavit attesting that the applicant:

    (1)

    Is currently registered with the Division of the State Fire Marshal;

    (2)

    Has in full force and effect commercial general liability insurance of at least one million dollars ($1,000,000.00); and

    (3)

    Possesses a certificate or other form of approval from the appropriate fire district or fire department that the proposed manufacturing or sales premises complies with all local codes and all NFPA standards.

    (b)

    Public displays. Prior to the conduct of a public display utilizing fireworks within Manatee County, a public fireworks display permit must be obtained from the county or municipality in which the public display is to be conducted. All permits are valid only for the event for which they are issued.

    (1)

    To obtain a county-issued indoor or outdoor display permit, an applicant shall:

    a.

    Complete a county-authorized application;

    b.

    Attach to the application form a written approval for the display event from the appropriate fire district or fire department;

    c.

    Submit a sworn affidavit that the display will be conducted by a competent operator, who shall be named in the affidavit and shall be licensed by the Federal Bureau of Alcohol, Tobacco and Firearms;

    d.

    Submit a sworn affidavit (with policy copy attached) that the applicant has obtained a general liability insurance policy with at least a five hundred thousand dollar ($500,000.00) limit to cover the public display event, and which lists the county or applicable municipality as an additional insured covering damages from any injuries or other legal claims, by any person or entity, arising from the public display event or acts incidental to the permitted display event;

    e.

    Provide a nonrefundable permit application fee of fifty dollars ($50.00); and

    f.

    Submit the completed application package, including supporting affidavits and documents, to the county at least fifteen (15) calendar days prior to the proposed public display.

    (2)

    Outdoor displays shall comply with the provisions of NFPA Code 1123.

    (3)

    Indoor displays shall comply with the provisions of NFPA Standard 1126.

    (4)

    The county public safety director or designee is hereby authorized to issue or deny public firework display permits for Manatee County.

    (5)

    Municipalities may set their own permit requirements.

    (c)

    Personal, noncommercial display of fireworks. Nothing herein shall be construed as permitting any personal, noncommercial display of fireworks.
