§ 2-21-90. Drought restrictions.
(a)
Whenever the Southwest Florida Water Management District imposes water use restrictions on Manatee County, the county administrator is hereby authorized, after consulting appropriate fire districts, to declare a moratorium on all otherwise lawful sales or uses of fireworks and sparklers throughout the county or areas thereof.
(b)
Whenever the Florida Division of Forestry Drought Index is six hundred fifty (650) or more for at least three (3) consecutive twenty-four-hour periods, all otherwise lawful sales or uses of fireworks and sparklers are automatically prohibited without further notice. The automatic prohibition shall continue until rescinded in writing by the county administrator. Notwithstanding the foregoing, otherwise properly permitted Independence Day displays occurring on July 4 shall not be subject to the provisions of this paragraph.
