Limits set; streets enumerated.

The following speed zones on county-maintained rights-of-way located within the unincorporated areas of the county and set forth below have been found to be susceptible to alteration or establishment of speed limits, apart from those speed limits set forth in F.S. Ch. 316. It shall be unlawful for any person to exceed the speed limits established for the speed zones as set forth herein.

All local residential streets: 25 mph.
a.
For the purpose of this subsection (2), the term "local residential street" shall have the following meaning and meet the criteria specified herein:
1.
It shall be defined as any county maintained public right-of-way used as a public road that is not designated as an arterial nor collector in the Functional Classification Section of the Manatee County Comprehensive Plan, that is not on the Manatee County Thoroughfare Plan, nor is serving as a primary traffic collection street within a subdivision.
2.
It shall be characterized by low average traffic volumes, short average trip lengths, and/or minimal through traffic movements with high access to abutting property. It shall be the sole responsibility of the Manatee County Public Works Director or his designee to interpret and apply these criteria and to approve the designation of the roadway as a local residential street.
3.
The board of county commissioners, reserves the right and authority to override the public works director or his designee for the designation of a given road.
b.
The Manatee County Public Works Department is hereby authorized to erect or cause to be erected appropriate signs in conspicuous locations upon all county rights-of-way included within the provisions of this subsection (2), in accordance with the following:
1.
On existing residential streets where local abutting residents have petitioned for and been approved by the Manatee County Public Works Director or his designee.
2.
On newly installed residential streets as approved by the Manatee County Public Works Director or his designee.
3.
At locations requested by the Manatee County Sheriff's Department because of safety and/or enforcement problems.
(b)
Signs. The county department of public works (highway division) shall erect appropriate "speed limit" signs in conspicuous locations within the paved travelway of the right-of-way of the speed zones designated in subsection (a).
(c)
Violation an infraction. Any person violating the provisions of this section shall be deemed to have committed a traffic infraction and shall be penalized as provided by Chapters 316 and 318, Florida Statutes.
