§ 2-25-34. Request for relief.
(a)
Filing of request for relief.
(1)
In order to initiate a dispute resolution proceeding, an owner shall file two (2) copies of a request for relief with the chairman of the board of county commissioners, Suite 903 of the County Administration Building, 1112 Manatee Avenue West, Bradenton, Florida. The chairman shall provide the originals to the county attorney's office.
(2)
Within ten (10) days of receipt of the request for relief, filed pursuant to Subsection 4 of the act, the county attorney shall forward one original of the request to a special master selected pursuant to section 2-25-35, below. This time period may be extended by agreement of the parties.
(b)
Notice of filing.
(1)
Concurrently with the forwarding of the request for relief to the special master, the county shall serve, by U.S. mail or hand delivery, a notice of filing the request for relief to any person who is:
a.
An owner of real property contiguous to the applicant's property at the address shown on the latest county tax roll; and
b.
A substantially affected person who:
1.
Submitted oral or written testimony of a substantive nature which stated, with particularity, an objection to or support for any development order or enforcement action at issue; and
2.
Specifically indicated a desire to receive notice of any subsequent dispute resolution proceedings occurring on the development order or enforcement action; and
3.
Provided the county with the person's name and address in writing prior to or at the time of the action on the development order.
(2)
The county shall provide a copy of the request for relief without any attached exhibits. The notice of filing shall contain any information necessary for the recipient to secure copies of any exhibits.
(3)
Any unintentional failure to notice potential participants shall be cured by posting of notices of the dispute resolution proceeding in a location in the lobby of the county administration building established by the board for that purpose by the county administrator.
