§ 2-25-39. Subpoenas.

  • Subpoena powers of the special master. Upon the request of any party, the special master may subpoena any non-party witnesses in the state who will aid in the disposition of the matter. A subpoena issued by a special master may require the witness to bring a document or thing.

    (1)

    A party requesting the subpoena of a non-party witness shall make such request in writing to the special master and provide a copy of such request with all other parties.

    (2)

    The special master shall only subpoena a witness that the master believes will aid in the disposition of the matter.

    (3)

    Parties subpoenaing witnesses shall be responsible for paying fees, costs and mileage in the amount as provided for under Florida law for witnesses in civil cases.

    (4)

    Service of subpoenas shall be made in the manner provided for by the Florida Rules of Civil Procedure.

    (5)

    The witnesses of either party that are present for the hearing or are on standby or available on call are not to be excused by either party without the concurrence of all other parties or the special master.
