§ 2-28-42. Definitions.

  • [For purposes of this article, the following words and terms shall have the meanings given in this section:]

    Agency: Any governmental entity, department or division.

    Applicant: Any person, firm, partnership, corporation or agency who has submitted an application to the county for an oversized vehicle/load permit, but has yet to be granted said permit.

    Blanket permit: An oversized vehicle/load permit issued to cover hauling over a given period of time not to exceed thirty-six (36) months.

    Board: The Manatee County Board of Commissioners.

    County: Manatee County, a political subdivision of the State of Florida, including its employees.

    Director: The director of the Manatee County Transportation Department and his/her duly designated representative(s).

    Oversized load: Any item(s) of property transported in or upon a vehicle, which individually or in combination with each other or in combination with the vehicle, exceed(s) the size or weight maximums specified in Chapter 316, Florida Statutes.

    Oversized vehicle: Every device in, upon, or by which any person or property is or may be transported or drawn upon a road, which exceeds the size or weight maximums specified in Chapter 316, Florida Statutes.

    Permittee: Any person, firm, partnership, corporation or agency who holds a currently valid oversized vehicle/load permit, said permit having been granted pursuant to section 2-28-44 of this article, or who continues to deal with the county pursuant to a permit which has expired.

    Right-of-way: Land in which Manatee County, Florida, owns a fee simple interest or has an easement dedicated to or required for use by the public as a public road.

    Road: Streets, sidewalks, alleys, highways, and other ways open to travel by the public, including the roadbed, right-of-way, underground utilities within the right-of-way, and all culverts, drains, sluices, ditches, water storage areas, waterways, embankments, slopes, retaining walls, bridges, tunnels, and viaducts necessary for the maintenance of travel.
