Article III. OVERSIZED AND OVERWEIGHT VEHICLES AND LOADS |
§ 2-28-44. Permits and criteria for issuance.
(a)
The director may approve an application/permit for an oversized vehicle/load. In reviewing a permit application, the director shall use the following criteria in approving, restricting or disapproving the application:
(1)
The number of lanes.
(2)
The condition of the pavement.
(3)
The number, adequacy, and control of points of access.
(4)
The adequacy of the width of the driving lanes.
(5)
The number and condition of bridges and overpasses.
(6)
The number and type of accidents occurring on the roads.
(7)
The number of fatalities occurring on the road(s).
(8)
The shoulder conditions and widths.
(9)
The average daily volume of traffic.
(10)
The volume of traffic during peak periods.
(11)
The peak hour operating speed of traffic.
(12)
The number of traffic signals per mile.
(13)
The number of miles of road that vehicles operate below open highway speed.
(14)
The number of miles with speed restrictions.
(15)
The continuity of routes between counties.
(16)
The frequency of necessary vehicular lane changes.
(17)
The availability of emergency lanes.
(18)
The method of separating opposing traffic.
(19)
The potential for conflicts with other modes of travel.
(20)
The presence of sight restrictions.
(21)
Bridge width and condition.
(22)
Availability of other modes of transportation.
(23)
All relevant details of the proposed move as presented by the applicant and as evident to the county.
(24)
Whether the load can be reasonably dismantled or disassembled.
(25)
Protection of the motoring public from traffic hazards created by the movement of overweight and oversized vehicles or loads on county roads.
(26)
The convenience and comfort of other motorists, including undue delays in the normal flow of traffic.
(27)
Prevention of damage to the road pavement, facilities, and structures.
(28)
Assistance needed by persons, companies, or organizations with special transportation problems, involving excess size or weight.
(29)
Whether vehicle(s) meet the county's minimum axle load and axle spacing requirements based upon structural analysis of the bridge structures to be crossed.
(30)
Whether the applicant indicates the routes over which the load can or cannot travel.
(31)
Failure to comply with this article when operating overweight or oversized vehicles or loads over county roads pursuant to previously issued permits.

Failure to comply with the permitting requirements of this article.
(b)
After approval of the application/permit by the director and payment of the required fee by the applicant, the director will issue a copy of the application/permit to the permittee.
(c)
The copy of the permit must be available for inspection at all times on or within the haul vehicle while work is being performed. Except as otherwise provided in this article, the operation or movement of any oversized vehicle/load on or within a county road right-of-way without a valid permit issued pursuant to this article, is prohibited. Except as provided by this article, any operation in progress in any right-of-way, or use of any right-of-way, without a valid permit, shall be suspended until such time as a valid permit is produced.
(d)
The permit is valid for a period to be set by the director, not to exceed six (6) months. The expiration date must appear on the permit. No work will be performed pursuant to an expired permit. Prior to expiration, the permittee may submit the permit to the director for an extension. The director may grant an extension by issuing a new permit, which permit may not be issued for a period of more than six (6) months. Only one such extension may be granted by the director.
(e)
Notwithstanding the provisions of subsection (d) above, the director may issue blanket permits to applicants who have established or will establish a regular routine of undertaking oversized hauls within county rights-of-way.
