§ 2-2-10. Fee for "911" service.

  • (a)

    Imposition of fee. There is hereby imposed a fee of not exceeding fifty cents ($0.50) per month per exchange line upon each individual local telephone subscriber served by the Manatee County "911" service up to a maximum of twenty-five (25) exchange lines for each such subscriber. An individual exchange line shall be as defined in the telephone company's tariff on file with the public service commission. If there is a surplus or deficit in the separate audit account for "911" fees required pursuant to F.S. § 365.171(13)(a)(1), the board of county commissioners shall, by resolution, adjust the monthly "911" fee in order to eliminate the surplus or deficit by resolution of the board of county commissioners.

    (b)

    Definitions. The definitions of terms set out in the "Florida Emergency Telephone Act," (F.S. 1985 § 365.171) are adopted as the definitions of terms applicable to this section.

    (c)

    Collection of fees. The fees imposed under this section shall be collected by the telephone company providing "911" services and equipment to Manatee County.

    (d)

    Billing. The telephone company providing "911" service to Manatee County shall include the fee imposed under subsection (a) in the telephone company's regular billing for telephone service.

    (e)

    Remittance of fees; retention of administrative fee. All fees collected under subsection (c), above, shall be remitted to Manatee County within thirty (30) days following the regular billing cycle utilized by the telephone company in billing its subscribers for telephone service. The telephone company is authorized to retain an administrative fee equal to one per cent of the fees collected as provided in F.S. § 365.171(13)3(c).

    (f)

    Use of fees. The fees collected hereunder shall be used by the county for nonrecurring charges for subsequent additions to "911" service and equipment and certain recurring charges as specifically authorized under the Florida Emergency Telephone Act (F.S. § 365.171). The county's eligible nonrecurring charges may be spread over a period extending beyond the fiscal year in which the `911" fee was collected, upon such approval by the state department of general services, communications division, as may be required by law. In calculating and approving the fee, the county's recurring eligible charges shall be spread over an annual period concurrent with the county's fiscal year.

    (g)

    Effective date of fees. The fees imposed hereunder shall be effective April, 1986, and continue in effect until otherwise terminated or adjusted.
