§ 2-2-62. Definitions.
The following words and terms shall have the following meanings unless some other meaning is plainly indicated:
Board shall mean the board of county commissioners of Manatee County, Florida.
County shall mean the County of Manatee, a political subdivision of the state.
Owner or owners shall mean the name and address of each person, partnership, trust, corporation or other entity being the title holder of each parcel of the property as disclosed by deeds or other instruments vesting title duly recorded among the public records of the county.
Participation shall mean the extent to which the property shall be subjected to special improvement assessment liens for the total cost and expenses of the project, recognizing that in the judgment and discretion of the board, said participation may be less than one hundred (100) per cent with the county or one or more persons, firms, corporations or entities assuming the balance of the total cost and expenses of the project.
Project shall mean the construction, paving, repaving, grading, curbing, draining, dredging, cleaning or other improvement, or any combination thereof, of any public road, bridge, culvert, sidewalk, bicycle path, canal, ditch or other waterway, or any continuous portion thereof or group thereof, together with all costs and expenses incurred or to be incurred for the labor and materials therefor, the engineering design thereof, the acquisition of any interest in real property for the right-of-way thereof, the construction and supervision of construction thereof, the administration of all proceedings for the institution and completion of the project, the financing thereof and the collection or enforcement of the special improvement assessment liens therefor. The county may complete the project with its own forces or may contract for the completion of the project and all costs and expenses in connection with any such contract shall be deemed a cost and expense of the project.
Property shall mean the real property abutting any portion of a project or proposed project.
Special improvement assessments or special improvement assessment liens shall mean liens specially assessed against the property for the benefit or improvement thereof caused by the project and shall constitute a lien upon the property so assessed of the same nature and to the same extent as the lien for general county ad valorem taxes falling due in the same year or years in which such special improvement assessment or installments thereof fall due, and any such special improvement assessment, or any installment thereof, not paid when due shall be collectible in the same manner and at the same time as such general ad valorem taxes are or may be collectible with the same interest and penalties and under the same provisions as to forfeiture as are or may be provided by law in the case of county ad valorem taxes.
Special improvement assessment roll shall mean a roll identifying the parcels of property, each owner of the parcels and the amount of the special improvement assessment against each parcel for the project.
Tax collector shall mean the tax collector of Manatee County.
