Article V. SPECIAL IMPROVEMENT ASSESSMENTS; PARTICIPATION PROJECTS |
§ 2-2-68. Second public hearing.
Upon completion of the project, the board shall cause to be published once a week for two (2) consecutive weeks in a newspaper of general circulation within the county, a notice generally describing the project and the location thereof, containing the proposed special improvement assessment roll for the total costs and expenses of the completed project and giving notice of the date and time of a public hearing before the board to consider acceptance of the project, final approval of the special improvement assessment roll and to hear objections of all interested persons and to make such other determinations as may be appropriate. If the total amount of the preliminary special improvement assessment roll exceeds the total costs and expenses of the completed project, the board shall cause the special improvement assessment roll to be amended at the time of any approval thereof to proportionately reduce the amount of each assessment thereon so that the total amount thereof equals the total costs and expenses of the completed project. In no event shall the total amount shown on the special improvement assessment roll exceed the total amounts shown on the previously approved preliminary special improvement assessment roll. The first publication of said notice shall be at least fifteen (15) working days prior to said public hearing before the board. Consideration of said matters by the board may be deferred or recessed by public announcement at the scheduled public hearing before the board to a subsequent meeting or meetings of the board without the necessity of further publication of such notice.
