§ 2-2-71. Enforcement and remedies.

  • Recognizing that the special improvement assessment liens constitute a lien upon the property of the same nature and to the same extent as the lien for general county ad valorem taxes collectible in the same manner and at the same time as such general county ad valorem taxes, the county shall have the further right, in the judgment and discretion of the board, to collect said assessments and to enforce said liens by instituting action in the circuit court of the county for the foreclosure thereof in the same manner and to the extent as a mortgage may be foreclosed under the laws of the state, or by instituting an action in rem in said court in the manner provided by law for the foreclosure and collection of ad valorem taxes. In any such action the county shall be entitled to a reasonable attorney's fee and all costs of collection including court costs.
