§ 2-2-107. Powers and duties.

  • Each hearing officer shall have the following duties as may be necessary:

    (a)

    To conduct administrative hearings as required by county ordinances, statutes, or other law;

    (b)

    To take testimony under oath and receive evidence as may be required to provide due process;

    (c)

    To make findings of fact and conclusions of laws in accordance with relevant standards and criteria set forth in the applicable statute, ordinance, or land development code provision;

    (d)

    To issue reports and make recommendations to the board of county commissioners;

    (e)

    To administer oaths and affirmations where authorized by law;

    (f)

    To issue notices to appear;

    (g)

    To receive relevant evidence as provided for in this chapter;

    (h)

    To take or cause such other action as necessary to ensure procedural due process to all participants, except that hearing officers shall have no subpoena power or authority to issue prehearing orders unless authorized by separate statute or ordinance.
