§ 2-2-210. Obligations of elected officials and other covered entities.

  • (a)

    To ensure the risk manager is aware of all potential sources of recovery for claims, and in order to coordinate coverage and avoid the purchase of duplicative policies, the metropolitan planning organization (if provided coverage by agreement), and all elected officials provided coverage under the county's self-insurance program shall provide to the risk manager complete copies of all insurance policies (including the terms of membership in any other governmental self-insurance programs) these covered entities may purchase or gain coverage from. In lieu of paper copies, this requirement may be satisfied by the transmission of electronic versions of these documents to the risk manager or the posting of them on the entity's web site and informing the risk manager of the location of such files. The obligation to inform the risk manager of external policies or coverage shall be continuing such that a new notification will be required at any time when a covered entity's coverage changes in any way.

    (b)

    To ensure that the risk manager is able to effectively make decisions concerning budgetary reserves and excess policy limits; and so as to facilitate the risk manager's role in collaborating with each covered persons and entities, each elected official and entity covered under this article (including the MPO to the extent provided coverage by contract) shall provide to the risk manager complete copies of all operating policies, including personnel, field work, building maintenance, safety and vehicle policies; as well as all general orders. In lieu of paper copies, this requirement may be satisfied by the transmission of electronic versions of these documents to the risk manager or the posting of them on the entity's web site and informing the risk manager of the location of such files. The obligation to inform the risk manager of these operating policies shall be continuing such that any amendments or additions to them shall also be communicated to the risk manager in a timely manner. The risk manager is entitled to review all such policies and to make recommendations to the covered entities with respect to how they may be revised to improve safety or reduce claim exposure.
