Chapter 2-31. WATER, SEWERS AND SEWAGE DISPOSAL |
Article I. IN GENERAL |
§ 2-31-1. Utilities department rules and regulations.
(a)
The board of county commissioners is authorized to promulgate and adopt, by resolution, all necessary and appropriate rules and regulations for governing the use, control, management and operation of the county utilities department and to amend and revise such rules and regulations as may be deemed necessary by appropriate resolution.
(b)
It shall be deemed a violation of this section and punishable as provided for herein, for any person or legal entity to violate or fail to adhere to any such rules and regulations promulgated for and on behalf of the county utilities department as provided for by this section.
(c)
In addition to the penalty set out in section 2-1-6, the county is hereby authorized and empowered to enforce any provision of this section, section 2-31-2 and 2-31-3 or any provision of the rules and regulations promulgated hereunder, or to seek redress for damages sustained by the county or the utilities department by persons violating this section, section 2-31-2 and 2-31-3 or any of the rules or regulations promulgated thereunder, by access to any court of competent jurisdiction for the purpose of obtaining any civil remedy available to the county.
