Chapter 2-31. WATER, SEWERS AND SEWAGE DISPOSAL |
Article IV. PUBLIC UTILITIES SYSTEM |
§ 2-31-101. Definitions.
As used in this article, the following words and terms shall have the following meanings, unless a different meaning clearly appears from the context:
Act shall mean the Florida Constitution; Chapter 125, Florida Statutes, as amended and supplemented; Part VII of Chapter 159, Florida Statutes, as amended and supplemented; Chapter 63-1598, Laws of Florida, Acts of 1963, as amended and supplemented; Chapter 197, Florida Statutes, as amended and supplemented; Chapter 403, Florida Statutes, as amended and supplemented; the solid waste ordinance; the stormwater management ordinance; and other applicable provisions of law.
Board shall mean the board of county commissioners of Manatee County, Florida, the governing body of the county.
Bonds shall mean any bonds, notes or other evidences of indebtedness issued under this article, and authorized by proper proceedings of the county, and shall include revenue bonds and notes which are payable from the fees, rentals or other charges derived from the operation of the system and shall also include revenue bonds, notes or other evidences of indebtedness which are secured in whole or in part by special assessments.
County shall mean Manatee County, Florida, a political subdivision of the State of Florida.
System shall mean the "Manatee County Public Utilities System" consisting of the water and sewer system, the solid waste system, and the stormwater management system, together with all properties relating thereto (real, personal and intangible) now or in the future owned or leased or under the control of the county, including but not limited to the facilities, franchises, management agreements and operational systems relating thereto, any facilities which may hereafter be a part thereof, by any additions, betterments, extensions or improvements thereto, all appurtenances whether man-made or natural, which are necessary, useful or convenient for the system. Pursuant to the terms and provisions of this article, the system shall also include, if determined by subsequent proceedings of the board to be in the best economic and financial interest of the county, any other county utility systems or public works enterprise now or in the future owned or operated by the county.
Solid waste ordinance shall mean Ordinance No. 91-26 creating and establishing the solid waste system and other ordinances heretofore enacted and incorporated by reference therein or relating thereto.
Solid waste system shall mean the county-wide solid waste collection and disposal system created pursuant to the terms and provisions of the solid waste ordinance.
Stormwater management ordinance shall mean Ordinance No. 91-25 creating and establishing the stormwater management system and all other ordinances amendatory or supplemental thereto.
Stormwater management system shall mean the county-wide stormwater management system created pursuant to the terms and county of the stormwater management ordinance.
Water and sewer system shall mean the combined water and sewer system created pursuant to resolution of the county adopted on April 11, 1978, and authorized pursuant to the terms and provisions of Chapter 63-1598, Laws of Florida.
Words of the masculine gender shall be deemed and construed to include correlative words of the feminine and neuter genders. Words importing the singular number shall include the plural number and vice versa unless the context shall otherwise indicate. The word "person" shall include corporations, associations, natural persons and public bodies unless the context shall otherwise indicate. Reference to a person other than a natural person shall include its successors.
