Article VI. LANDSPREADING |
§ 2-31-171. Prohibited acts.
(a)
Landspreading is prohibited within the Watershed Overlay-Manatee (WO-M) or Watershed Overlay-Evers (WO-E) districts, as designated in the Manatee County Comprehensive Plan.
(b)
The landspreading of untreated, improperly treated, or unstabilized domestic wastewater residuals, domestic septage, food establishment sludge, or citrus processing wastewater residuals inconsistent with an approved FDEP permit, is prohibited in Manatee County.
(c)
Landspreading of any domestic wastewater residuals, domestic septage, food establishment sludges or citrus processing wastewater residuals that may be toxic or hazardous in nature is prohibited in Manatee County.
(d)
The dumping or disposal of domestic wastewater residuals, domestic septage, food establishment sludge, citrus processing wastewater residuals, chemical/portable toilet waste, holding tank sludge, and industrial wastewater residuals is prohibited in Manatee County.
(e)
The commingling of domestic wastewater residuals, domestic septage, food establishment sludge or citrus processing wastewater residuals together with hazardous wastes, chemical/portable toilet sludge, holding tank sludge, food establishment sludge or domestic wastewater residuals together with hazardous wastes or industrial wastewater residuals, and the dumping, disposing or landspreading of such mixtures on land within Manatee County is strictly prohibited.
(f)
Hauling from the point of origin to a designated site within Manatee County and landspreading of domestic wastewater residuals, domestic septage, food establishment sludge, or citrus processing wastewater residuals shall be prohibited between the hours of 10:00 p.m. and 6:00 a.m., except for scheduled maintenance operations at the POTW, WWTP, or citrus processing plant, or under emergency conditions as determined by the POTW, WWTP or citrus processing plant manager/operator. Written notification by the manager/operator of the POTW, WWTP or citrus processing plant of the need to engage in landspreading activity during off hours, as a result of a scheduled maintenance event, shall be provided to the department seventy-two (72) hours prior to the maintenance event. In the event of an emergency condition, as determined by the manager/operator of the POTW, WWTP or citrus processing plant, verbal notification of the need to landspread during off hours shall be provided to the department on the next working day, followed by written notice within seventy-two (72) hours.
(g)
The creation of objectionable odors as a result of the landspreading of domestic wastewater residuals, domestic septage, food, establishment sludge or citrus processing wastewater residuals shall be prohibited. In the event that objectionable odors are created by a permitted landspreading operation, the hauler shall, at the request of the director, take appropriate steps to abate the odor nuisance such as ceasing application of the materials, disking the materials into the soil, or applying lime to the field(s) from whence the objectionable odors emanate.
