Article VI. LANDSPREADING |
§ 2-31-176. Reporting requirements.
(a)
Landspreading activity notice and reporting.
(1)
Haulers shall notify the department no less than ten (10) days prior to the commencement of any landspreading activity to allow department staff to inspect the landspreading site for conformity with all applicable rules, regulations and the provisions of this article.
(2)
Haulers shall submit records required under this section to the department on a monthly basis, due by the fifteenth day of the month following the end of the month during which landspreading operations occurred. Reports shall document the following:
a.
Source and volume of materials.
b.
Date and place (site and spreading zones) of application.
c.
Weather conditions at time of application.
d.
Copies of the most recent reports submitted to FDEP containing chemical analyses of land-applied materials, plus any additional analyses that may be required by the department under subsection 2-31-173(a)(7) of this article.
e.
Water table measurement as determined by the use of water level obstruction points installed on the site.
f.
Hauling company name and notarized signature of the authorized agent of the hauling company.
(b)
Incident reporting. In the event of an incident involving the transporting, or landspreading of domestic wastewater residuals, domestic septage, food establishment sludge or citrus processing wastewater residuals regulated by this article, the hauler, applicator or generator responsible for causing a defined incident situation shall:
(1)
Report the fact to the department and the local public health unit immediately. Incidents occurring after hours or on weekends shall be reported to the Manatee County Emergency Communications Center by calling 747-HELP or the Manatee County Sheriff's Office by calling 747-3011.
(2)
Attempt to contain the spilled material and reduce the number of pathogens by application of lime or other suitable biocide to the spilled material.
(3)
Begin cleanup and removal of spilled materials as soon as possible.
(4)
Submit a written incident report within seven (7) working days to the director. This report shall include the following minimum information:
a.
The name and address of the responsible person(s).
b.
Description of actions taken to mitigate the incident.
c.
The final disposal site for the waste material.
d.
The cause of the incident.
e.
Description of actions that will be taken to prevent future incidents.
