Article VI. LANDSPREADING |
§ 2-31-178. Exemptions.
(a)
This article shall not apply to the landspreading of domestic wastewater residuals on the grounds of the POTW or WWTP where such residuals were generated, in the event of an emergency, and if such activities are consistent with the facility's FDEP construction or operating permit; or at a sanitary landfill that has been permitted by the FDEP.
(b)
This article shall not apply to the landspreading, dumping or disposal of domestic wastewater residuals categorized as Class "AA" by the Florida Department of Environmental Protection.
(c)
The provisions of this article shall not apply to the landspreading, dumping or disposal of animal manures as a means of fertilizing crops or enriching the soil. However, such activities shall not be conducted in a manner that would constitute a public or private nuisance under Section 823.14(4), Florida Statutes, the Florida Right to Farm Act.
(d)
This article shall not apply to hauling or landspreading operations performed for septage management facilities that treat less than ten thousand (10,000) gallons per day, monthly average daily flow, or less than twenty thousand (20,000) gallons in a single day. These activities and facilities are regulated by the Florida Department of Health (FDH) in accordance with Chapter 10D-6, Florida Administrative Code.
