§ 2-19-104. Definitions.

  • The definitions in Chapter 538, Part I, Florida Statutes (2013), as they may be amended from time to time, are specifically incorporated herein. In addition, the following definitions shall apply to this article:

    (1)

    "Code enforcement officer" means any designated employee or agent of Manatee County whose duty it is to enforce codes and ordinances enacted by Manatee County, or designated employee or agent of the municipalities whose duty it is to enforce codes and ordinances of the municipalities, respectively. Employees or agents who may be code enforcement officers for purposes of this article may include, but are not limited to, code inspectors, law enforcement officers and law enforcement civilian employees, animal control officers, building inspectors, or fire safety inspectors.

    (2)

    "Electronic device" means any device capable of making or transmitting still or moving photographs, video recordings, or images of any kind; any device capable of creating, transmitting, or receiving text or data; or any device capable of receiving, transmitting, or recording sound. Electronic devices include, without limitation, film cameras, digital cameras, video cameras, any other type of camera, cellular telephones, tape recorders, digital voice recorders, portable gaming systems, global positioning satellite units, portable computers, personal digital assistants, and their accessories.

    (3)

    "Household appliance" means any oven, stovetop, microwave, refrigerator, stand-alone freezer, washer, dryer, dishwasher or window-mounted air conditioning unit.

    (4)

    "Jewelry" means a personal ornament that contains any gold, silver, or platinum, or any combination thereof, and may contain gemstones.

    (5)

    "Personal identification card" means a valid Florida driver's license, a Florida identification card issued by the Department of Highway Safety and Motor Vehicles, an equivalent form of identification issued by another state, employment authorization issued by the United States Bureau of Citizenship and Immigration Services that contains an individual's photograph and current address.

    (6)

    "Secondhand dealer" means any person, corporation, or other business organization or entity which is not a secondary metals recycler subject to article III and which is engaged in the business of purchasing, consigning, or trading secondhand goods.

    (7)

    "Regulated secondhand goods" means any secondhand goods that constitute jewelry, electronic devices, or household applicances.

    (8)

    "Secondhand goods" means personal property previously owned or used, which is not regulated metals property regulated under article III and which is purchased, consigned, or traded as used property. Such secondhand goods do not include office furniture, pianos, books, clothing, organs, coins, motor vehicles, costume jewelry, cardio and strength training or conditioning equipment designed primarily for indoor use, and secondhand sports equipment that is not permanently labeled with a serial number. For purposes of this paragraph, "secondhand sports equipment" does not include golf clubs.

    (9)

    "Seller" means any person from whom the items regulated under this article are acquired.

    (10)

    "Transaction" means any purchase, consignment, or trade of secondhand goods by a secondhand dealer.

    (11)

    "Transaction form" means the written form containing transaction data completed by a secondhand dealer, in the format approved by the Florida Department of Law Enforcement.

    (12)

    "Transaction record" means the electronically submitted transaction form consisting of transaction data described in section 2-19-105(1) of this article compiled by a secondhand dealer in the format approved by the Florida Department of Law Enforcement and the Manatee County Sheriff's Office.
