§ 2-21-44. Prohibition of unattended donation boxes on private property.

  • All unattended donation boxes are prohibited on all private property in the unincorporated areas of the county except under the following conditions:

    (a)

    Unattended donation boxes may be allowed on property where the primary structure is used by a not-for-profit organization, as defined by state statute, and the box is used exclusively to support the not-for-profit organization;

    (b)

    Unattended donation boxes shall be maintained in good condition and appearance with no structural damage, holes, or visible rust, and shall be free of graffiti;

    (c)

    Unattended donation boxes shall be locked or otherwise secured;

    (d)

    There shall be no advertisement of any kind on the box except for the identity of the charitable organization and the purpose of the donation effort;

    (e)

    Unattended donation boxes shall contain the following contact information in two-inch type visible from the front of each unattended donation box: The name, address, email, and phone number of the donation box owner and operator.
