§ 2-25-37. Participation in the dispute resolution proceeding.
(a)
Request to participate in proceedings. Within twenty-one (21) days after receipt of the request for relief transmitted by the county, any candidate for participant status may request from the special master permission to participate in the proceeding. If the special master determines that the person qualifies for participant status, these persons may be permitted to participate in the hearing to the extent allowed under the act.
(b)
Filing of response. As required under the act, the county attorney, with assistance from the planning department and other departments, shall file a response to the request for relief.
(c)
Sufficiency hearing; request to be dropped as a party.
(1)
Prior to any hearing on the merits of the request for relief, the special master may conduct a hearing on whether the request for relief should be dismissed pursuant to Subsection 8 of the act.
(2)
At any time, the special master may conduct a hearing on any request to be dropped as a party pursuant to Subsection 16(c) of the act.
(3)
All parties in the matter shall receive fifteen-day notice by U.S. mail or hand delivery regarding the date, time, and location of the sufficiency hearing.
