§ 2-25-38. Hearings.
(a)
Notice and timing of dispute resolution proceeding.
(1)
A special master shall, within forty-five (45) days after the master's receipt of the request for relief, hold a hearing within the county on the merits of the request, unless a different date is agreed to by all the parties. The special master must provide notice of the hearing to all parties and other persons who have requested such notice at least forty (40) days prior to the hearing.
(2)
Notice to all parties and participants shall contain the following information:
a.
Application number and date of filing;
b.
Location and total area of the property;
c.
Present zoning and comprehensive plan designation of the property;
d.
Time, place, and date of the hearing; and
e.
Instructions for obtaining further information regarding the request for relief.
(b)
Costs.
(1)
The cost of preparing and filing the initial two (2) copies of the request for relief shall be borne by the property owner. The cost of preparing and serving copies of the request for relief on qualifying participants shall be borne equally by the parties.
(2)
The cost of preparing and filing of the response to the request for relief shall be borne by the county.
(3)
The special master's expenses in providing notice shall be borne equally by the parties.
