§ 2-2-11. Purchase of basic subsistence for county employees and EOC volunteers during emergencies.

  • (a)

    Definitions. For purposes of this section, the following words shall be defined as follows:

    Disaster emergency is defined as provided in the Manatee County Disaster Emergency Management Powers Ordinance (Ordinance 05-029 as amended or replaced).

    Emergency or other emergency is defined as any circumstance related to the services or programs provided by Manatee County that was not anticipated or planned for in advance and, if not promptly corrected, resolved, or mitigated, could result in a serious risk of loss to the health, safety, or welfare of people in Manatee County, or loss of or damage to property, real or personal, in Manatee County, or loss of resources in Manatee County, including, but not limited to, natural and financial resources.

    Personnel is defined as Manatee County employees, Emergency Operations Center (EOC) personnel, designated emergency support personnel, and volunteers.

    Protective measures is defined as set forth in the Federal Emergency Management Agency's Public Assistance Guide, dated October 1999.

    Volunteers is defined as set forth in F.S. § 125.9501.

    Workplace is defined as a fixed facility or essential field operations supporting a response to a disaster emergency or involved in the emergency.

    (b)

    Expenditures authorized. The purchase of food and materials and supplies related to the preparation and serving of food to provide meals for personnel restricted to the workplace while preparing for or during disaster emergencies and other emergencies is hereby authorized in accordance with the following:

    (1)

    The county administrator or acting county administrator shall determine when preparation for a disaster emergency should begin, in consultation with the department director charged with oversight of emergency management activities, whether circumstances constituting an emergency exist, and approve the beginning and end of the time period when food shall be made available to personnel. The determination shall be consistent with this section.

    (2)

    The county administrator shall establish procedures, subject to review and approval by the clerk of the circuit court, applicable to the purchase, use, and disposition of food, materials, and supplies acquired pursuant to this section.

    (3)

    Food, materials, and supplies authorized herein may be provided to personnel only when the period of restriction to the workplace is anticipated to exceed six (6) hours.

    (4)

    The purchases authorized herein shall be by the most economical means under the circumstances, and extravagances shall be avoided.

    (5)

    A log of names of persons fed and invoices for food, materials, and supplies, along with information identifying the anticipated or actual emergency disaster or other emergency, shall be maintained and submitted to the clerk's finance department together with the determination of the county administrator or acting county administrator pursuant to subsection (b)(1).

    (6)

    Unused perishable food and shelf-stable food approaching its expiration date shall be considered surplus and shall be donated to nonprofit organizations providing food and meals for the needy. The donating department will be responsible for obtaining a detailed receipt from the agency receiving the food.

    (7)

    For disaster emergencies:

    a.

    Nonperishable food, materials and supplies may be purchased and stored in advance in accordance with funds budgeted and the county's purchasing policies.

    b.

    The nature and amounts of such expenditures shall be documented.

    c.

    The expenditures will be charged to an emergency account established for a particular anticipated or actual disaster emergency event if an account has been established.
