§ 2-2-233. Definitions.

  • As used in this article the following words and terms shall have the meanings respectively ascribed:

    Assets include all cash and property owned by members of the family unit, including bank accounts, stocks, bonds, trust funds, certificates of deposit, automobiles, trucks, vans, motorcycles, boats, trailers, land, and buildings.

    Board means board of county commissioners of Manatee County, Florida.

    Covered fees means those fees, assessments and charges required or imposed by the board for essential health and welfare services or projects as identified from time to time by resolution of the board.

    Disabled means a person who has a physical or mental impairment which substantially limits the persons ability to obtain employment; and the person has a record of having such an impairment as certified by at least one physician; or where the applicant has obtained tax exempt status for totally and permanently disabled persons under F.S. § 196.101; or has been found eligible under any state or federal program applying similar criteria.

    Earnings or family earnings means gross income thirteen (13) weeks prior to date of application.

    Elderly means a person sixty-five (65) years of age or older.

    Eligible recipient means a family or individual determined to be a permanent resident of Manatee County.

    Family includes husband, wife and minor children related by blood, marriage or law living in the same household.

    Income includes gross earnings during a thirteen (13) week period prior to submission of the application, and includes net income from self-employment, child support, alimony, unemployment compensation, workers' compensation, veteran's pension benefits, social security, pensions, annuities, dividends, interest on bank accounts and bonds, income from estates and trusts, net rental income, gifts of cash, royalties, the face amount of food stamps, and contributions to one or more members of the family unit from any source.

    Owner means one who holds legal or beneficial title to real property in Manatee County; or one who is the relative of a decedent who holds legal title or beneficial title to such real property and has paid all ad valorem taxes on the property in the prior year.

    Permanent residence, as stated in F.S. § 196.012(18), means that place where a person has his true, fixed, and permanent home and principal establishment to which, whenever absent, he has the intention of returning.

    Permanent resident an individual determined to have a permanent residence in the county without limiting the foregoing:

    (1)

    A visit to Manatee County prior to application for assistance does not constitute such an individual a resident of Manatee County;

    (2)

    The length of time an individual is physically present in manatee County is not a factor in determining his or her residence.

    Relative means one who is related to the owner as father, mother, son, daughter, brother, sister, uncle, aunt, first cousin, nephew, niece, husband, wife, stepfather, stepmother, stepson, stepdaughter, stepbrother, stepsister, half brother, or half sister.
